Suppose: you drive daily over the A12 towards Bezuidenhout and your car insurer suddenly refuses renewal. Often a CIS registration is behind this of which you were unaware. The Centraal Informatie Systeem (CIS) compiles fraud incidents, suspicions and risky claims that insurers share among themselves. Such a note blocks new policies for years.

The contents of the CIS register

Three types of data are recorded:

1. External Referral Register (EVR)

Heaviest category. This lists persons or companies where fraud has been established or is highly probable. Registration can last eight years. Insurers almost standardly refuse new cover.

2. Incidents Register

Lighter registrations concerning claims with elevated risk, without proven fraud. Standard five years visible.

3. Risk Register

General risk profiles such as prior claims or residence in districts with high claims history. Not always fraud-related.

Removal of an incorrect entry

Follow this route:

Step 1: request the file

Request the complete fraud file from the insurer that registered the entry. This way you know exactly what the notification is based on.

Step 2: submit a notice of objection

Send a reasoned letter with your explanation, supporting documents such as alibis or counter-expert reports and an explicit request for removal. The insurer responds within four weeks.

Step 3: Kifid procedure

In case of rejection you can go to Kifid. There too you can contest the registration yourself. Duration six to twelve months, own contribution fifty euros.

Step 4: judicial intervention

In complex cases or substantial damage: summary proceedings or ordinary proceedings before the Rechtbank Den Haag for immediate removal or damages.

Damages possible

The Hoge Raad has held insurers liable for incorrect registrations. Missed policy opportunities, higher premiums and lawyer’s fees can lead to awards ranging from several thousand to tens of thousands of euros.

Important time limits

  • Limitation period: five years from the moment you become aware of the registration (article 3:310 BW)
  • Maximum EVR duration: eight years, thereafter automatic removal
  • Kifid time limit: within one year after written rejection of your objection
