Recusal and Exclusion in Objection Procedures
In objection procedures, a member of the objection committee may be recused if bias is suspected, on the basis of Article 7:17 Awb. This protects the integrity of the advisory process.
Grounds for Recusal
- Personal interests: Family ties or financial involvement.
- Prior statements: Previous public opinions on the case.
- Appearances of bias: Conduct during the hearing.
Procedure
The objector submits a recusal request to the committee chair. If granted, a replacement is appointed. The decision on recusal is not revocable and binding. In exceptional cases, this suspends the procedure.
Practical examples show that recusal is rare (less than 5% of cases), but crucial for trust. This aligns with broader principles of good administration.
