Exceptions to the Points System for Rent Increases

Not every rent increase falls under the points system. Exceptions apply for large-scale maintenance, improvements such as insulation or a new bathroom, provided they are invoiced and approved. Landlords may then charge a 'improvement increase' of up to 80% of the costs, in addition to the regular indexation.

In case of mutation (new tenant) or interim agreements in the tenancy agreement, deviations are possible. Room rentals and temporary contracts fall outside. For luxury apartments with gross rent above €1,000, no limit sometimes applies. The Good Landlordship Act limits excesses. Tenants must give written consent for additional increases. In case of dispute, the cantonal court decides. Example: installing solar panels justifies 5% extra. In 2024, the government caps increases at 5.3% for private sector homes under €1,100.
