Not all tenants are subject to income-dependent rent increases. Exceptions apply to newly built homes (first two years), temporary contracts shorter than two years, and rental prices below the liberalisation threshold (€808.06 in 2024) in the regulated sector. Rent increases may also be moderated or waived in cases of income reduction or retirement.

In the event of divorce, only the income of the primary tenant is considered. For expatriates with foreign income, the regulation does not always apply, provided this can be proven. During the COVID-19 crisis (2020-2022), rent increases were temporarily prohibited. Landlords are not permitted to increase rent in cases of ongoing disputes or payment arrears. These exceptions prevent unfair rent increases and promote fairness.
