In apartment complexes with an Owners' Association (VvE), service costs are often handled through the VvE. The landlord collects these costs and pays them over to the VvE. Tenants have the right to insight into VvE decisions and annual accounts. The deed of division determines which costs are for the account of tenants, such as reservations for maintenance funds. Landlords may not charge additional costs on top of VvE contributions. Disputes are handled primarily through the VvE meeting, then the Rent Tribunal or district court. Important: check whether the landlord as VvE member votes in the interest of tenants. Recently amended VvE law requires active VvEs with reserve funds. Tenants can demand inspection of VvE administration via the landlord. In case of mismanagement, the court may appoint an administrator. As a tenant: read the lease agreement for VvE clauses and compare settlements with VvE minutes. This prevents double payments or neglect.
