Rolling WWS-maximum: cumulative effects over multiple years
Understand the rolling WWS-maximum and prevent cumulative exceedances over years. How do you calculate this and what to do in case of 'catch-up' increases?

The WWS-maximum does not apply in isolation per year, but rolls over cumulatively. Landlords may not skip the maximum in one year to double the increase later, pursuant to article 7:901 of the Dutch Civil Code (BW). The total increase over years may never exceed the compound maximum. Suppose: 2% in 2023 and 3.4% in 2024, then the accumulation is approximately 5.5%. Does a new increase exceed this? Challenge it! RVO calculates this via the rent index formula. For the free sector, check via the Huurcommissie tool. For housing associations, the DAB limit applies. Tenants often see 'catch-up' increases; these are invalid without judicial approval. Demand transparency in calculations. In case of exceedance: retroactive reduction and compensation possible. Keep a rent history and compare annually. This prevents creeping price inflation and protects long-term tenants.
