Landlord's Repair Obligations in Case of Defects

Landlords are obligated to maintain the rental property in good condition (Article 7:204 of the Dutch Civil Code). In case of defects such as broken heating or leaks, repairs must be carried out within a reasonable timeframe. Tenants may demand a rent reduction or take legal action. Failure to remedy defects may sometimes serve as grounds for lease termination. Defects should be reported in writing, including photographs and deadlines. If the landlord fails to respond, tenants may engage an expert themselves and recover the costs. The Rent Tribunal provides advice in case of disputes. For serious defects, emergency rights apply: tenants may temporarily reside elsewhere at the landlord's expense. Minor repairs (under €50) are the tenant's responsibility. Document everything for potential legal proceedings. This protects against housing insecurity and is linked to termination rights. Landlords thereby avoid claims.
