Partner Maintenance for Students: After the Parents' Duty of Support

Partner maintenance follows child maintenance: rules for student couples according to article 1:157 CC, with calculation and conditions.

Partner maintenance is a logical continuation of the parental duty of support, especially for student couples. Article 1:157 CC regulates contributions between partners during cohabitation.

Conditions

Both partners must be studying or have a gap in income. The maintenance obligation applies until 1 year after the last study.

Calculation

Based on capacity to pay and need, often 50/50 with equal income. Rent, study books and living expenses are included.

Difference with child maintenance

In contrast to the 18-21 obligation, partner maintenance does not end at a fixed age, but upon self-sufficiency. Courts scrutinise more strictly for cohabiting couples.

Example: A working partner pays €400 to the studying partner, adjusted upon job change. Divorce? Maintenance continues until end of study.
