The maximum amount of a security deposit for the lease of retention land, such as caravan sites or storage areas, is not statutorily fixed as it is for residential properties. In practice, one to two months' rent is often used as a guideline, based on reasonableness and fairness under Article 6:248 of the Dutch Civil Code (BW). Landlords may not demand excessive amounts, otherwise the tenant may refuse the security deposit or challenge it later in court. For parking spaces, the security deposit is typically lower, around €100-€500, depending on the location and duration. For larger plots such as gardens, it can amount to €1,000. The contract must explicitly state the amount, including interest calculation (statutory interest if the landlord does not deposit it separately). Tenants: negotiate the security deposit and demand proof of deposit into a blocked account. Landlords: avoid disputes by requesting market-conform amounts and a clear description of retention conditions. If reasonable limits are exceeded, the sub-district court may reduce the security deposit. Always consult the specific lease contract and any industry conditions for parking or recreational land.
