Wage Claim after Unlawful Dismissal: Up to What Amounts?
In the case of null dismissal, you do not go through a notice period and retain your right to wages. How do you claim and calculate this?
Statutory Rules
Article 7:677 of the Dutch Civil Code (BW) requires payment until four weeks after dissolution. In the case of a prohibited reason, this often extends further via a damages claim. Maximum amounts: up to €80,000 gross per year, depending on seniority.
Calculation Examples
- Monthly salary €4,000: €16,000 for 4 weeks.
- With damages: Up to full-time equivalent until new job.
Courts often award 6-12 months' wages. Use CNV tools for simulations. (189 words)
