When and how does seizure occur?
Seizure of the driving license by the police or Public Prosecutor's Office (article 130 WVW 1994) is an acute measure in case of suspicion of unfitness, such as alcohol or drug use. The physical driving license is confiscated and forwarded to the CBR for investigation.
Procedure and options
- Police decides on the spot; you receive a letter for CBR examination.
- Within 14 days, you can apply for a temporary driving license from the Public Prosecutor's Office.
- Not getting it back leads to suspension or revocation.
Duration: up to 6 months investigation. Costs are at your expense. Failure to cooperate results in suspension. Difference with CBR: police acts directly, CBR administratively. Criminal prosecution often follows. Insurers report incidents, which increases premiums. File an objection with the Public Prosecutor's Office within one week with medical evidence.
