Indexing and Adjustment of WWS Maximum Rent

Annual indexing of WWS rent: rules, maximum percentages and how to object to excessive increases.

The WWS maximum rent is indexed annually based on inflation and wage development, as regulated in Article 7:243 of the Dutch Civil Code (BW). Landlords may adjust the rent as of 1 July, with a maximum increase of 5.3% in 2024 for social rent. Tenants receive a proposal; tacit consent does not apply. Objecting within six weeks halts the increase until a decision is made. For mid-range rent (WWS-light), more lenient rules apply. Municipalities may deviate in cases of quality improvements, such as insulation. Tenants with low income qualify for rent allowance, which compensates for the indexing. Follow the ministerial decree in the Bulletin of Acts and Decrees (Staatsblad) for exact percentages. Example: a rent of €700 increases to €736.10. Unlawful increases are recoverable.
