Indexation of service costs must not fall below the WWS maximum, but is often a sneaky route. Article 7:892 DCC separates bare rent from service costs, which may be indexed annually based on CPI (consumer price index). However, landlords sometimes bundle this with rent increases, which is invalid. Check the specification: fixed costs (lift) versus variables (cleaning). Only CPI adjustment is permitted, not the WWS percentage. Request annual accounts and compare with CBS inflation figures. Exceedance? Refute per item. The Rent Committee tests this separately. Avoid the pitfall by invoicing bare rent and service costs separately. In case of abuse: demand rent reduction. Stay alert for this grey area.
