Rental Deposit: Withholding and Refund upon Termination

The deposit protects the landlord. When may it be withheld, and how can you reclaim it?

Rules Regarding the Deposit

A maximum of two months' rent (Article 7:266 of the Dutch Civil Code). Keep it in a blocked account. At the end of the lease: refund within one month after handing over the keys.

Grounds for Withholding

Only for damage or arrears, with evidence. Cleaning does not qualify unless contractually agreed. Dispute? Refer to the Rent Tribunal or court.

Step-by-Step Guide

Prepare a handover report, take photographs, and request a written refund. In case of refusal: issue a summons. Interest and legal costs are often borne by the landlord in case of unjustified withholding. (198 words)
