After termination and re-letting, the rent cannot simply be increased without limits. The Dutch Rent Act restricts increases to the points system or the liberalisation threshold (€808.06 in 2024). For the liberalised sector: negotiation is possible, but the rent must remain a reasonable market price. Tenants have a two-month cooling-off period upon renewal. In cases of eviction for personal use: the same rent must apply to the new tenant.

Procedure: The landlord must demonstrate liberalisation if the WOZ value exceeds €266,000. Dispute? The Rent Tribunal will decide within months, with potential reimbursement. Example: old rent €900, new rent €1,200 – the tenant may claim moderation if below the threshold.

Protection against excessive rent is enforced through fines of up to €20,000. Annual indexation is capped at 4.2% in 2024. Document all correspondence. These rules prevent abuse and ensure affordable succession.
