Rental Agreements and Indexation
When entering into a rental agreement, the price must comply with the points system for regulated rent. Indexation follows the Consumer Price Index (CPI) and occurs annually on 1 July. Landlords send a proposal with the calculation. Tenants have one month to consider. If no response is received, the increase is automatically applied. For the unregulated sector, free negotiation applies, but the points system remains relevant in case of disputes. Important: always include a service charge overview. Unlawful indexation may result in reclaims. Case law emphasises transparency in contracts. Use model agreements from the Dutch government for certainty. This minimises future conflicts between parties.
