Consequences of Mediation for Ongoing Rental Proceedings

How does mediation affect an ongoing rental procedure? Learn about suspension, confidentiality, and strategic tips for parties.

Mediation during an ongoing rental proceeding has specific consequences. An interim mediation agreement can suspend the court case pursuant to article 49 Rv, provided that the parties report this. In case of success, the procedure often lapses; in case of failure, it resumes. In rental law, this prevents double costs in eviction cases. Important: the court can order mediation, but the parties must cooperate voluntarily. Article 7:902 BW regulates confidentiality, so that mediation discussions cannot be used against you. Practical example: The District Court of Rotterdam suspended a rental dispute, resulting in an agreement on a payment arrangement. Risk: if one party does not cooperate, this can weaken your position. Tip: document all steps and consult a rental law attorney. This preserves flexibility in dynamic rental relationships.
