Exceeding the income cap has direct consequences for tenants of social housing. First, you will receive a letter from the housing corporation requesting income details. Within two months, you must demonstrate that your income remains below the threshold. If you fail to do so, a proposal for a rent increase to market sector levels will follow, often 30-50% higher. If no resolution is found within a year, the landlord may terminate the rental agreement through the courts (Article 7:271 of the Dutch Civil Code). You will be granted a maximum of two years to relocate. During this period, you will not accrue passive housing rights. Practical examples show that 20% of those exceeding the cap move to more expensive rental or purchase properties within a year. An objection can be lodged with the Rent Tribunal if the housing corporation fails to comply with the rules. For vulnerable groups, such as individuals aged 65 and over, exceptions may apply under the Hardship Clause. Prevent escalation by promptly reporting your situation and exploring alternatives, such as priority status for another social housing property.
