A landlord may not withhold the deposit arbitrarily. According to Article 7:220 of the Dutch Civil Code (BW), there must be demonstrable damage or overdue payments. Damage must be reported and invoiced with receipts within a reasonable period. In case of dispute, you can involve the Huurcommissie (Rent Tribunal). Always prepare a detailed handover report with photos at check-in. If the landlord withholds unjustly, you are entitled to interest from the end date of the tenancy.
