Objection Procedure Against Inappropriate Allocation

Step-by-step objection against an inappropriate housing offer from a housing association. From complaint to court.

Have you received housing that does not fit? Start an objection procedure. First, informally complain to the housing association within 8 weeks after the allocation decision. No solution? Go to the Rent Tribunal for binding advice, free and within 10 weeks. If dissatisfied: go to the district court for annulment of the decision.

Gather evidence: rental offer, your registration, income details and medical reports. The Good Landlordship Act obliges housing associations to hear and be heard. Success rates are around 60% in Rent Tribunal cases. Costs: court fee €85 at the court, recoverable upon success. Time pressure: carry out within 6 weeks after rejection to avoid time constraints.
